TIMBERON WATER & SANITATION DISTRICT MINUTES FOR THE MEETING OF DECEMBER 17, 2005 A regular meeting of the Timberon Water & Sanitation District Board of Directors was held on December 17, 2005 at 10:00 AM in the community center. Board members present were Joan Schug, Tom Tannehill, Betty Phillips, Larry Hanson and Sid Benson. Joan Schug reviewed the agenda pointing out an error on the date of the agenda. She changed the date from November to December and asked if anyone had any objections to continuing the meeting in spite of the clerical error. There were no objections. Sid Benson moved to table the Sierra Transportation Contract Renewal until the Wednesday meeting to review the fuel cost adjustment clause. Tom Tannehill seconded the motion. Larry Hanson abstained from voting and everyone else voted in favor of the motion. Minutes of the November 19th and 30th of 2005 meetings were read and approved. The Treasurer’s Report for November of 2005 was also approved. Bill Gideon presented the General Manager’s Report. Old Business: Betty Phillips moved to accept the amended Resolution 05/06-006 changing the names of an election judge and the alternate judge. The motion passed unanimously after being seconded by Tom Tannehill. New Business: Sid Benson moved to accept the recommendation of our attorney to amend the counterclaim (Beagles et al vs. TWSD lawsuit). Tom Tannehill seconded the motion. Joan Schug, Betty Phillips, Tom Tannehill and Sid Benson voted in favor of the motion and Larry Hanson voted against it. Joan Schug asked the directors to look at the regular meeting schedule for 2006. Betty Phillips requested that the board hold a Wednesday work session prior to the Saturday meeting. These meetings will be held at 6:00 pm. Debbie Goss will prepare a resolution for the Wednesday, December 21st meeting. Agenda Request: Virgil Beagles felt that the qualification for electors is illegal. He asked why TWSD is spending so much on legal fees. He asked Tom Tannehill to explain why the election procedures are valid. Mr. Tannehill replied that a protocol was established to verify a voter’s eligibility. The process is similar to voting in a county bond election. This process was reviewed by the Secretary of State’s Office, the Attorney General’s office and the Legislative Council. Director Remarks: Larry Hanson stated that it was a good meeting. Sid Benson thanked everyone for attending the meeting as well as the Meet the Candidate forum on Thursday. Joan Schug asked about money from the Forest Service for road material. Bill Gideon assured her that the money has been paid to TWSD but no material is available from the Sacramento road project. Tom Tannehill wished everyone a Merry Christmas. Betty Phillips announced that this may be her last meeting as a director because of a lawsuit filed by Virgil Beagles. If it is her last she has done her best as Treasurer. Her fate will be decided in court on December 28th. 1
