TIMBERON WATER & SANITATION DISTRICT MINUTES FOR THE MEETING HELD ON OCTOBER 19, 2005 A meeting of the board of directors of the Timberon Water and Sanitation District was called to order on October 19, 2005 at 3:00 P.M., in the community center. Board members present were Joan Schug, Sid Benson, and Tom Tannehill. Betty Phillips and Larry Hanson were absent. Sid Benson moved to approve the second budget adjustment for fiscal year 05/06. Tom Tannehill seconded the motion and it passed unanimously. Sid Benson moved to approve a resolution defining the 2006 election and Tom Tannehill seconded the motion. Debbie Goss reported on a meeting with Mary Quintana, Chief Deputy Clerk for Otero County. Debbie and Tom Tannehill discussed election procedures with Ms. Quintana to be sure the 2006 election will be run as correctly as possible. The County Clerk’s office will try to conduct a training for poll workers the first week of January. They also met with the Otero County Treasurer, Grace Gonzales, to be sure the Qualified Elector Certification met with her approval. Resolution 05/06-006 passed unanimously. Bill Gideon thanked Tom Tannehill, Joe and Karen Mainello, and Debbie Goss for the large amount of research for the election procedures. Bill Gideon presented some background on the anti donation clause of the New Mexico Constitution. He has received some complaints that allowing anybody to use the community center without paying rent is considered a donation. He wants the board to be aware of the complaint. Attorney, Melissa Reeves, will look into the legal aspects of the complaint. The board expressed regret that the building cannot be used by the community free of charge and would like to see any rent charged be a minimal amount. The meeting was adjourned.
